Terms and Conditions
The following rules govern Your stay at the Property and Your relationship with TCSFVR. For purposes of this Contract, the defined term “You” includes every person listed on Your Reservation. By making your Reservation, You consent to all terms and conditions contained herein.
- Payment Upfront. You agree to pay all rent and fees requested by TCSFVR no less than fourteen (14) days prior to Your arrival at the Property. If You fail to do so, TCSFVR may deny You access to the Property.
- Unpaid Balances, Fees, Fines. You authorize TCSFVR to charge Your credit card on file for any unpaid balances, fees, or fines incurred during the Reservation.
- Primary Guest. The individual signing this Contract will be listed as the primary point of contact for your Reservation. By signing, You as signer acknowledge and agree that You are at least eighteen (18) years of age.
- Cancellation Policy
- You may cancel Your Reservation within twenty-four (24) hours from the moment of booking, and receive a full refund.
- After the first twenty-four (24) hours, cancellations more than fourteen (14) days prior to the check-in date are subject to a cancellation fee equal to ten percent (10%) of the total fee paid by you to TCSFVR for your Reservation (the “Total”).
- After the first twenty-four (24) hours, cancellations less than fourteen (14) days prior to the check-in date are not eligible for a refund.
- For reservations that are twenty-eight (28) days or longer, cancellations less than sixty (60) days prior to the check-in date are not eligible for a refund.
- Reservations made on a third-party online travel agency are subject to the cancellation policies that are advertised on that platform. TCSFVR has no control over, nor responsibility for, the policies of third parties.
- If You cancel due to a medical emergency or unavoidable travel interruption beyond Your control and are not eligible for a refund, You may provide documentation of the foregoing to TCSFVR. TCSFVR may elect to apply the dollar amount of Your Deposit, minus any cancellation fee, to a future reservation at the same Property within one (1) year from the dates of the original Reservation. Any such future reservation will be charged at the Rental Rate for the Property applicable on the date of the future reservation, regardless of the rate on the original Reservation.
- Check-in and Check-out
- Check-in time is 4:00 PM Mountain Time.
- Check-out time is 10:00 AM Mountain Time.
- You may request early check-in and/or late check-out, by contacting TCSFVR no less than twenty-four (24) hours prior to the arrival or departure in question. Because of the time required to clean and service the Property after each guest departs, TCSFVR does not guarantee that such requests can be accommodated.
- Long-Term Guests. Any Guest who stays longer than 28 nights is considered a long-term Guest.
- If You are a long-term Guest, You agree supply to supply Your own toiletries, cleaning, laundry, and other supplies beyond standard TCSFVR provisions.
- You also agree to pay a cleaning fee that is double the advertised cleaning fee for the Property. One mid-stay cleaning is available to long-term guests, subject to cleaning staff scheduling. You may request additional cleanings for an additional fee.
- Noise. You agree to be respectful of local noise ordinances, and considerate towards neighbors at all times. Quiet hours are between 10:00 PM to 7:00 AM Mountain Time.
- Smoking. You may not smoke or use smokeless tobacco or cannabis products inside any building on the Property. Smoking and vaping are allowed outside, at least (15) feet away from any door or window and at least (20) feet away from any adjoining property. If If You violate the terms of this Section 8, TCSFVR will charge a $1,000 smoking fee to Your credit card on file.
- Parties & Events. You may not have Parties, events, and gatherings of more than double the maximum listed occupancy of the residence on the Property, without advance written permission from TCSFVR. For each calendar day on which an unapproved event, party, or gathering occurs on the Property during Your Reservation, TCSFVR may charge a one thousand Dollar ($1,000) unauthorized event fee to Your credit card on file.
- Parking.
- If parking is available for the Property, You agree to follow all parking rules and regulations, which may include displaying a parking permit.
- You and anyone You permit onto the Property may park only in designated parking areas. If You are not certain where You are permitted to park, contact TCSFVR immediately for additional instructions. Otherwise, You will be deemed to have read and understood parking rules for the Property.
- Any illegally parked cars are subject to towing and fines. You are solely responsible for any fees or fines arising from improper parking at the Property or its designated parking spaces.
- You may not permit any trailers, vans, or recreational vehicles (RV’s) onto the Property.
- Lost Keys and Parking Permit. At the time of check-out, You agree to return all keys, garage openers, and parking permits for the Property. TCSFVR will charge a $200 fee to Your credit card on file for each key, garage opener, or parking permit, which is not returned in the manner required in the Property Guide which you have or will receive electronically prior to check-in. If loss of a key or garage opener requires replacement hardware, TCSFVR will also charge to Your credit card on file the costs of replacement hardware and labor.
- Water/Plumbing.
- The Property may be on well water or city/county water, and may have a different taste or smell than You are accustomed to. TCSFVR will not reimburse or discount the Total, or make any stay modifications due to the taste or smell of the water.
- DO NOT FLUSH anything (including feminine products) other than toilet paper and human waste. If You fail to follow this rule, TCSFVR may charge You for any damages incurred by TCSFVR and the Property Owner, including professional plumbing services and losses from subsequent reservations for each day the Property is not available to future guests due to plumbing outages.
- Air Conditioning.
- You acknowledge that You have read and understand the kind of air-conditioning that the Property has or does not have. Not all properties have air-conditioning.
- Swamp/evaporative coolers are not available during the winter months. If the Property has air-conditioning, it is available only from June 1st – September 30th.
- Wifi, Television, and Streaming Services.
- You are solely responsible for any media purchases You make during the Reservation.
- You acknowledge that You have read and understood the advertised entertainment amenities available.
- You agree to log out of all personal streaming accounts before check-out.
- TCSFVR has no control over, nor responsibility for, outages of wifi, cable television or streaming services caused by the provider of those services. TCSFVR will not refund or discount the Total based on unavailability of wifi, cable television or streaming services during the Reservation.
- Entry for Repairs. TCSFVR and third-party contractors hired by TCSFVR may enter the Property for the purposes of repair and inspection, with at least twenty-four (24) hours advance notice to You. TCSFVR will exercise this right of access in a reasonable and respectful manner, with a goal of minimizing disruptions to Your stay. TCSFVR and/or third-party contractors may enter the Property without notice if TCSFVR determines an emergency condition exists requiring such access.
- Damage to Furnishings and Furniture. You agree to keep the property and all furnishings in good order, and refrain from causing any damage beyond ordinary wear and tear. You may not rearrange or permit anyone to rearrange the furniture in the Property. If You rearrange the furniture in the Property without prior written approval from TCSFVR, TCSFVR may charge a five hundred Dollar ($500) reset fee to Your credit card on file.
- Accidental Damage Waiver
- The Total includes a one-time, non-refundable Accidental Damage Waiver fee that covers up to $1000 worth of repairs or replacements should damage occur on the Property during Your Reservation.
- The following are excluded from Accidental Damage Protection and are not covered by the Accidental Damage Waiver:
- Injury to persons or animals;
- Damage caused by willful or grossly negligent acts or omissions of You or Your guest(s);
- Damage not reported to TCSFVR prior to Your departure;
- Remediation of damage or odors caused by smoking or vaping (tobacco and/or cannabis) indoors, or within 15 feet of a doorway.
- Failure to return keys or garage openers to the lock box provided;
- Lost or stolen items;
- Damage to the Property caused by pets or service animals;
- Misuse of appliances;
- Misuse of plumbing, HVAC, electrical, or other systems;
- Misuse of fireplaces;
- Damage to a pool or hot tub on the Property, or leaving the water in a condition that requires draining and refilling; and
- Any other act or omission for which a specific fee is provided in this Contract.
- Pet Policy.
- Trained service animals are permitted on the Property, in compliance with State of New Mexico and federal law.
- Unless the Property is advertised as pet-friendly, You may not bring pets onto the Property or permit any of Your guests to do so.
- If the Property is advertised as pet-friendly, You may bring one (1) dog with You onto the Property, unless You obtain advance written permission from TCSFVR to have more than one (1) dog. All other types of pet animals are strictly prohibited.
- For non-service animals, TCSFVR may charge You a non-refundable pet deposit.
- If You fail to disclose to TCSFVR that You have a pet on the Property and pay the pet deposit, TCSFVR may charge a $1000 pet fee to Your credit card on file.
- With the exception of trained service animals, the following dogs are not permitted at any time: Pit Bulls; Bully breeds; Rottweilers; dogs which weigh more than one hundred (100) pounds; dogs which have ever been reported to a governmental entity for biting or other aggressive behavior; dogs which may become aggressive to neighbors, vendors, TCSFVR staff, or other animals; and dogs which are not up-to-date on all vaccinations.
- You may not permit any of Your guests or invitees to bring a pet onto the Property at any time. If You violate this 18, Your guest or invitee and their pet may be removed from the Property immediately.
- You are solely responsible for the wellbeing of Your pet(s) or service animal while on the Property. TCSFVR and the Property Owner assume no responsibility for illness or injury that may occur to Your pet or service animal in connection with Your stay on the Property.
- Pets are not allowed for stays longer than fourteen (14) days unless approved in advance by TCSFVR.
- You agree to dispose of all animal waste in sealed plastic bags, and place it into the outdoor trash bin. If You fail to do so, TCSFVR will charge a $500 waste removal fee to Your credit card on file.
- Animals are not allowed on furniture at any time. Evidence of animals on furniture (pet hair, bodily fluids from pets, or damage to the furniture itself) may result in additional cleaning fees.
- You are fully responsible for any damage caused by Your pet or service animal to the Property and its furnishings, including but not limited to landscaping. You agree to reimburse TCSFVR for the cost of repairing or replacing anything on the Property damaged by Your pet or service animal.
- You agree to prevent Your animal(s) from making excessive noise that disturbs neighbors, or remove the animal(s) from the Property until they can return quietly. If You fail to do so, TCSFVR may terminate Your Reservation and require You to vacate the Property, or require You to board Your animal(s) off-site at Your sole expense. No refunds will be given in these circumstances.
- It is Your sole responsibility to comply with all New Mexico, County of Santa Fe and City of Santa Fe laws and ordinances as related to dogs.
- Emergency Services and Fire Alarms. You are solely responsible for all charges/fees arising out of a call by You, or anyone invited onto the Property by You, to emergency services or 911. This includes Police, Ambulance and Fire services. For those properties equipped with an alarm system, any fines associated with false alarms caused by You will be Your sole responsibility. TCSFVR may charge any such fines or fees to Your credit card on file.
- Fireplaces and Fire Pits.
- Wood burning fireplaces and fire pits are not available for use from May 15th – October 15th, and flues must remain closed during this time.
- You agree to abide by all burn bans instituted by state, city, and county. TCSFVR will not issue any refunds or discounts or relocations due to burn bans. You are solely responsible for determining whether a burn ban is in place prior to using the fireplace or fire pit during Your Reservation.
- You agree to exercise caution when building a fire, and follow all instructions provided regarding the fireplaces.
- You may not under any circumstances leave fire unattended.
- You agree to keep a fireplace screen on any fire in a fireplace. If no fireplace screen is provided, You may not build a fire in that fireplace.
- You may not throw any paper products or other combustible materials in the fireplace or fire pit.
- You may not leave children or pets unattended near the fireplace or fire pit—even briefly. TCSFVR and the Property Owner have no responsibility for injuries to children or animals which arise from use of a fireplace or fire pit during Your Reservation.
- If You choose to clean the fireplace or fire pit, place all ash from the fireplace in the provided covered container, after it is completely extinguished and the ashes cool. Never place actively burning coals into the ash bucket.
- You agree to turn off all gas fireplaces and fully extinguish all wood burning fires before going to bed or leaving the property.
- If a fireplace is marked as decorative only, You may not use it. Doing so could cause extreme damage to the Property or cause the Property to catch fire.
- You are responsible for all damages caused by smoke or fire. These damages are not covered by the accidental damage waiver.
- TCSFVR and the Property Owner have no responsibility for injuries to You or anyone You permit onto the Property, arising from use of a fireplace or fire pit during Your Reservation.
- Pools. If there is a pool offered as an amenity on the Property, the following rules apply:
- Use of the pool is at Your own risk. TCSFVR and the Property Owner are not responsible for any injuries to You or anyone You permit onto the Property, arising from use of the Pool or corresponding equipment during Your Reservation.
- If You have sand, gravel, dirt, heavy amounts of lotion, cosmetics, food and beverages, or any other contaminants on Your body or bathing wear, You must wash them off prior to entering the hot tub.
- You agree to supervise all children on the Property at all times when they are using the Pool, or within twenty (20) feet of the Pool. If You breach this Section 21(c), TCSFVR may cancel Your Reservation and require You to vacate the Property.
- TCSFVR and its vendors or agents may access the Pool at regular times to service the Pool and corresponding equipment.
- You may not make any repairs or adjustments to the Pool and corresponding equipment, or to any electrical wiring for the Pool and corresponding equipment. If You believe that a repair or adjustment to the Pool and its corresponding equipment is necessary, You must notify the Property Manager immediately. TCSFVR will make commercially reasonable efforts to make the repair or adjustment and restore use of the Pool in a timely fashion.
- You are responsible for the full cost of any damages for repair and/or replacement of the Pool and corresponding equipment which may be incurred by TCSFVR or the Property Owner due to Your acts or omissions on the Property. TCSFVR may charge such damages to Your credit card on file.
- You agree to operate the Pool and corresponding equipment in accordance with the manufacturer’s instructions and in a safe, responsible manner.
- You may not allow Your pet(s) or service animals to enter the Pool at any time, except for a service animal performing a medically necessary action in its capacity as a service animal.
- You acknowledge that the Pool and corresponding equipment are strictly an amenity and that the use of these amenities is not guaranteed under the terms of this Contract. TCSFVR will not issue any refund or discount due to interruption or non-availability of the use of the Pool and corresponding equipment.
- You acknowledge that outdoor Pools are not available for use from the day after Labor Day to the day before Memorial Day.
- Communal Pool availability is subject to HOA scheduling when applicable.
- Hot Tubs. If there is a hot tub offered as an amenity on the Property, the following rules apply:
- You may use the hot tub only between the hours of 7:00 AM Mountain Time and 10:00 PM Mountain Time.
- If You have sand, gravel, dirt, heavy lotion, cosmetics, food and beverages, or any other contaminants on Your body or bathing wear, You must wash them off prior to entering the hot tub.
- If TCSFVR receives a complaint about excessive noise, or You use the hot tub outside of the permitted hours listed above, TCSFVR may revoke permission to use the hot tub.
- You may not exceed maximum capacity for the hot tub. Maximum capacity can be found in the Property Guide, and may also be found on the hot tub itself.
- The following are not permitted in the hot tub or its surrounding area at any time:
- Children under the age of five (5);
- glass bottles and containers;
- glassware and dishes, except those made of plastic or melamine;
- Food and beverages;
- Electrical and/or battery-powered appliances;
- Persons with medical conditions that may be exacerbated by exposure to hot water;
- Persons who have had diarrhea or vomiting within the previous forty-eight (48) hour period;
- Persons who are under the influence of alcohol, drugs, and/or any prescription medication which is contraindicated for hot tub use.
- Children under the age of sixteen (16) may not use the hot tub unless accompanied by a parent or guardian.
- You may not leave children under the age of sixteen (16) unattended in the hot tub or its surrounding area at any time—even briefly. If You do so, TCSFVR may terminate Your Reservation and require You to vacate the Property. TCSFVR will not issue any refund or discount if Your Reservation is terminated early due to Your breach of this provision.
- You may not adjust the water temperature of the hot tub or disconnect it from its power source. The temperature is set between 101 – 104 degrees Fahrenheit, according to environmental and manufacturers’ requirements. Changing the water temperature may damage the hot tub, or incur expenses for TCSFVR in restoring the proper water temperature. Restoring proper water temperature can take up to twenty-four (24) hours. If You change the water temperature or disconnect the hot tub from power without the express permission of TCSFVR or its contractor, TCSFVR may charge a $100 hot tub fee to Your credit card on file. TCSFVR may also revoke Your permission to use the hot tub for the duration of Your Reservation.
- You agree to always replace the cover over the hot tub when not in use.
- The water in each hot tub is fully inspected and maintained between all reservations. TCSFVR may charge a $250 refill fee to Your credit card on file if the hot tub water must be treated extensively or refilled due Your introduction of contaminants or prohibited materials into the water.
- Gyms/Fitness Equipment. If there is a gym or fitness equipment available for use on the Property, the following rules apply:
- Children under the age of sixteen (16) may not use the gym or fitness equipment.
- You agree to:
- Inspect all equipment prior to use.
- Use equipment only for its intended purpose.
- Refrain from using the gym or equipment while intoxicated, ill, or physically unfit.
- TCSFVR, the Property Owner, and their agents make no representations or warranties regarding the safety, functionality, or maintenance of the equipment or facility.
- You acknowledge and agree that there are no staff or medical personnel on-site. If anyone using the gym or fitness equipment requires medical care, You are solely responsible for locating and obtaining that medical care.
- You acknowledge that use of any onsite fitness equipment, gym, or workout facilities provided at the Property involves inherent risks of personal injury, illness, or even death. Use of any gym or fitness equipment at the Property is entirely at Your own risk.
- You expressly waive and release any and all claims and causes of action, now known or hereafter known, against TCSFVR, the Property Owner, and their agents, arising out of injury, illness, property damage, or death resulting from Your use of a gym or fitness equipment at the Property.
- You agree to indemnify, defend, and hold harmless TCSFVR, the Property Owner, and their agents, from any claims threatened or asserted against TCSFVR and/or the Property Owner, and any liabilities, losses, or expenses (including attorneys’ fees) incurred by TCSFVR and/or the Property Owner, arising from Your use or Your guests’ use of the gym or fitness equipment.
- Compliance with Laws. You agree to abide by all municipal, county, state and federal laws for the entirety of Your Reservation on the Property. You may not use or possess any illegal drugs at any property owned/managed by TCSFVR. TCSFVR may enter the Property and contact law enforcement without notice if illegal activity is suspected. You agree to immediately cooperate with law enforcement and emergency personnel in the event they are called to the Property. If You or anyone You permit onto the Property is involved in illegal activity, TCSFVR will immediately terminate Your Reservation and have You removed from the Property. TCSFVR will not issue any refund or discount if Your Reservation is terminated due to illegal activity.
- Weapons. You may not bring any weapons onto the property, or permit Your guests and invitees to do so.
- Force Majeure. TCSFVR is not liable for any failure or delay in performance resulting from acts beyond its reasonable control, including but not limited to acts of God, natural disasters, changes to law or regulations, labor disputes, civil disturbance, war, terrorism, pandemic, and utility outages.
- Comparable Accommodations. In the unlikely event that the Property Owner breaks their contract with TCSFVR and causes the Property to no longer be available for the dates of the Reservation, after the Reservation is made and Deposit charged, TCSFVR will offer comparable accommodations. Should You not accept the comparable accommodations, TCSFVR is not obligated to make any reduction and/or refund of the Rental Fee. If a comparable accommodation is not available, TCSFVR will inform Guest with as much notice as possible and provide a full refund.
- Breach and Termination. Any violation of the terms contained within this Contract shall constitute a material breach of the lease. If You breach this Contract, TCSFVR may initiate legal proceedings in accordance with applicable local and state regulations to have the You removed from the Property. TCSFVR may file legal action to seek judgment against You for any monies owed to TCSFVR or the Property Owner resulting from the Your breach. If TCSFVR, the Property Owner, and/or their agents and employees incur expenses in enforcing their rights under this Contract, You are responsible to reimburse those expenses, including reasonable attorneys’ fees. You are solely responsible for reasonable attorney’s fees and expenses of TCSFVR, the Property Owner, and their agents and employees, if You are unsuccessful in any claim You bring against the Property Owner and/or TCSFVR. This Agreement is governed by the laws of the State of New Mexico, and the Parties agree that venue for any legal action between the parties is appropriate in Santa Fe County, New Mexico.
- Indemnification. Guest shall protect, defend, indemnify, and hold harmless the Property Owner, TCSFVR, and their agents and employees from and against any and all liability, damages, claims, suits, liens, and judgments—of whatever nature—including claims for contribution and/or indemnification, for injuries to or death of any person(s), or damage to the property or rights of others, arising from the acts or omissions of Guest or anyone Guest permits to enter the Property in connection with the Reservation.
- Personal Property Waiver. TCSFVR and the Property Owner are not responsible for the personal property of You and any person You permit onto the Property. This includes but is not limited to vehicles and any personal property left in vehicles on the Property. You agree to secure Your personal property from theft or damage throughout Your stay.
- Packages Waiver. TCSFVR is not responsible for any packages sent to the Property in Your name, before, during, or after Your Reservation. If You need to have a package delivered to You in connection with Your stay, You may contact TCSFVR to see if it is possible to make arrangements for delivery. TCSFVR cannot guarantee that such arrangements will be available.
- General Waiver. Guest waives any and all claims, complaints, grievances, charges, demands, and actions of any kind against TCSFVR and the Property Owner, whether known or unknown, arising from the Reservation and their stay on the Property, except those based on intentional or grossly negligent misdeeds of TCSFVR or the Property Owner. This release includes but is not limited to claims in contract, quasi-contract, tort, based upon common law, equity, local or state or federal ordinance or statute, and claims for attorney’s fees and costs. The Property Owner and TCSFVR are not responsible for any accidents, injuries or illness that occur while on the premises or its facilities.
- Opportunity to Review. You acknowledge and agree that You have had an opportunity to review this Contract and its contents within twenty-four hours of making the Reservation, and that You understand and consent to its terms without exception.
Marketing Emails. TCSFVR may send You marketing emails using contact methods provided during the reservation process.
